Section 267 of the Crimes (Administration of Sentences) Act 1999 provides that a person must apply to the Commissioner of Corrective Services NSW for approval to conduct research that involves the person (or persons acting under the direction of that person) obtaining access to:

  • information held by Corrective Services NSW or a management company, or
  • facilities administered or managed by Corrective Services NSW or a management company, or
  • persons employed in, or engaged by contract to, Corrective Services NSW or a management company, or
  • persons in the custody of, or supervised by, Corrective Services NSW or a management company.

To assist the Commissioner to assess applications under section 267, CSNSW has established an Ethics Committee. This Committee ascertains whether proposed research would be ethical, having regard to factors such as an inmate's right to privacy. The Ethics Committee is established in accordance with clauses 171 and 172 of the Crimes (Administration of Sentences) Regulation 2001.

If the records which you seek, or seek to create (eg by interviewing inmates), relate to research work of a social science nature, you should make an application to:
